Terms of Service

These Terms of Service ("Terms") govern your access to and use of the FlightCrew Pro mobile application and related services (the "Service") provided by FlightCrew Pro ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & accounts

You must be at least the age of majority in your jurisdiction and capable of forming a binding contract to use the Service. You are responsible for the accuracy of your account information and for safeguarding your credentials. You are responsible for all activity that occurs under your account.

2. Planning aid — not an official source

FlightCrew Pro is a productivity and planning aid only. It does not replace, and must not be relied upon in place of, your operator's official schedules, dispatch releases, crew-tracking systems, flight plans, or any regulatory compliance system. Duty-period, rest, weather, and flight-status outputs are estimates derived from third-party and device data and may be incomplete, delayed, or inaccurate. You remain solely responsible for verifying all operational and regulatory information against your operator's approved sources and for all decisions you make. Nothing in the Service constitutes operational, legal, or regulatory advice.

3. License to use the Service

Subject to these Terms and the accompanying End-User License Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial flight-crew purposes.

4. Acceptable use

You agree not to:

• Use the Service in violation of any law, regulation, or third-party rights;
• Reverse engineer, decompile, or attempt to extract source code, except as permitted by law;
• Interfere with, disrupt, or place undue load on the Service or its infrastructure;
• Scrape, resell, or redistribute data obtained through the Service;
• Circumvent or misuse rate limits, security, or access controls.

5. Third-party data & services

The Service incorporates data and services from third parties, including ADS-B, FlightAware, Cirrum, the FAA, and AviationWeather.gov. Such data is provided subject to those providers' own terms and is offered on an "as is" basis. We do not control and are not responsible for the accuracy, availability, or content of third-party data or services, and we are not affiliated with or endorsed by these providers.

6. Intellectual property

The Service, including its software, design, text, and branding, is owned by us or our licensors and protected by intellectual-property laws. Except for the limited license granted to you, no rights are transferred. Third-party names and marks remain the property of their respective owners.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DATA WILL BE ACCURATE OR TIMELY.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR USD $50.

9. Indemnification

You agree to indemnify and hold harmless FlightCrew Pro and its officers, employees, and agents from any claims, damages, liabilities, and expenses arising from your use of the Service or your violation of these Terms.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Sections that by their nature should survive termination will survive.

11. Changes to the Service & Terms

We may modify or discontinue the Service, in whole or in part, at any time. We may also update these Terms; when we make material changes we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which FlightCrew Pro is established, without regard to conflict-of-laws principles. [Specify governing jurisdiction and venue before publishing.]
